MATRIMONIAL & FAMILY LAW

Matrimonial & Family Law

On a scale of 43 life events causing stress, divorce comes in second only to the death of a spouse. This is true even when both parties agree that a divorce is in their best interest. The stress is compounded when there are children involved.

At Erickson Webb Scolton & Hajdu, we are dedicated to our clients and selective about the cases we take. We recognize that each family law case is unique. We make sure that we can devote the time and attention to the facts of each individual case and thoroughly explore all options. We limit the number of cases we take so that we can focus on the details and work hard to provide the best possible outcome for all those involved. A few family law issues we can help you with include:

  • Enforcement or disruption of prenuptial agreements.
  • Divorce, whether uncontested or contested.
  • Legal separations.
  • Spousal support or maintenance (alimony).
  • Child custody.
  • Child support.
  • Child visitation.
  • Paternity issues.
  • Modifications of custody or support orders.

Asset and debt division is another issue. New York is an equitable distribution state. The first step involves identifying separate and marital property and debt. Marital property and debt is then divided equitably, which does not mean equally. The court takes many factors into consideration when making a property distribution order.

We also prepare Qualified Domestic Relations Orders (QDRO) to assist parties in obtaining their share of a pension fund or retirement plan benefit. These are somewhat complicated and other attorneys refer their clients to us to handle this aspect of their client’s divorce process.
