The Consequences of a Speeding Ticket
Many people simply decide to plead guilty to a speeding offense by signing their ticket. However, there are many reasons why it pays to fight a speeding ticket. While a first offense may simply yield a fine and slight insurance rate hikes, consequences increase for a second or subsequent ticket. Some of these consequences include:
- Large fines
- Points against your license
- Insurance rate increases
- Mandatory court costs
- Revocation of driver's license
- Driver Responsibility Assessment — A civil penalty that is payable to the Department of Motor Vehicles (DMV) that is separate and distinct from court costs. This is not a criminal penalty, but rather a civil penalty.
Depending on how high over the speed limit the driver was going, the consequences become increasingly worse. The New York State system assigns points according to speed:
- 1 to 10 mph over the speed limit — 3 points
- 11 to 20 mph over the speed limit — 4 points
- 21 to 30 mph over the speed limit — 6 points
- 31 to 40 mph over the speed limit — 8 points
- 41+ mph over the speed limit — 11 points
Out-of-state Offenders
Motorists from other states that receive a speeding ticket in New York can suffer consequences in NY and their home state. New York has reciprocity with several other states. If you are an out-of-state motorist who has received a traffic violation in New York, talk to an attorney who understands the consequences you may be facing.
